Sun Belt or independent. I don't think there is a snowball's chance in hell you'll see them in CUSA.

Interesting that CUSA is screaming at their departing members, "The C-USA Board of Directors will exhaust all necessary legal actions", Translation, "DON'T YOU DARE LEAVE ME!!, I WILL MAKE YOUR LIFE A LIVING HELL IF YOU TRY TO LEAVE EARLY"

I think this is all just posturing trying to get a larger payout for leaving...

By going ahead and scheduling they are trying to show how much lost revenues there would be for opponents in CUSA. CUSA is saying breach of contract by the 3 teams not giving a 14 month contractual notice. However, CUSA has set some precedent for previous teams leaving, and the leaving teams are saying CUSA has not lived up to their contractual obligations. Attorneys gonna make money here. We'll see what the settlement is...

I'm not defending the teams leaving because I do get that you agree to terms and should either do them or pay a penalty but the only reason CUSA is fighting like they are is because they are butt hurt that those teams are leaving them for the Sun Belt. Just 15-18 months ago they thought nobody would leave them for the Sun Belt. They have been so arrogant and thought the Sun Belt was no threat and it turns out the Sun Belt has surpassed them. They are upset so I get it. Also like you said about the lawyers that they are going to make their money as well.

My buddy who lives in that area of WVA says everything he has read or heard is that Marshall will be playing a Sunbelt schedule this season ---

As Vannini mentions in his column and interview posted above, Conference USA, which is headquartered in Texas, would have to file suit in Mississippi, West Virginia and Virginia in local courts against public universities, which typically have sovereign immunity. Add in the SBC3's arguments that CUSA refused to engage in good-faith negotiations, that's a difficult case to prove to a judge.

I expect to have 14 football-playing full members in the Sun Belt this fall.

boom...that refusal to negotiate is going to be big, and it's not like the C3 don't have their own legal counsel. Easy way out is now the negotiations begin, and the CUsa gets a little larger payout from the 3 schools.

There is an opinion that The Sunbelt will not publish a schedule with them on it yet. They don't want to be named in a lawsuit.

I don't know either but it seems that the Sunbelt wouldn't have an legal problems - the 3 schools have accepted membership and told the SB they will play football this season -

To this point the SB offices have not been involved. They told the 3 if they could get out of CUSA early they’d be welcome here. Publishing a schedule opens them to litigation.

If the schedule comes out on time we’ll all know the 3 didn’t get their deal with CUSA done in time. If it’s delayed it’s a lock that they’re in with us.

Whether it does or not will ultimately be decided by a judge. Anybody can sue anybody. SBC may just be taking a cautious approach as long as they can.

As said above this is all posturing to try to minimize damage (CUSA) and squeeze what they can out of settlement. Each school has probably already baked their worst case scenario in their decision by this point and course is set (move to SBC for fall 2022). It’s the attorneys time to try to minimize exit costs. The legal process may take longer to play out in court even after the train has left the station.
